The summons for extension of time was dismissed and leave to appeal refused because the applicant failed to show a reasonable prospect of success or any other reason in the interests of justice: the delay was inexcusable, no palpable error was demonstrated in the judge's reasoning, and the merits did not justify extending time without a full hearing.

Because the applicant's delay was substantial, no credible reason for the delay was provided, and the intended appeal had no realistic prospect of success as no error of law or procedural unfairness was identified, the Court refused to extend time to appeal and dismissed the summons as futile.

The Judge was entitled to assess the merits on the evidence; the plaintiffs' case was sufficiently strong and simple on the evidence (including a clear funds trail and receipt by the defendant), the defendant's evidence was unsatisfactory and he had not sworne to his statements nor disclosed his whereabouts, and his fugitive/contempt status made it proper to refuse security for costs; there is no basis to disturb the exercise of judicial discretion and no reasonable prospect of success on appeal.

The delay of nearly eight months, coupled with the absence of any arguable grounds for judicial review (the TCAB's factual findings were entitled to be made and no error of law was shown), meant it was futile to extend time to appeal; accordingly the summons was dismissed and no oral reconsideration permitted.
