There was a good arguable cause of action against all three defendants, the Lucky Man shares constituted assets within the jurisdiction and there was a real risk of dissipation; although material non-disclosure at the ex-parte stage occurred, it did not produce an unjust advantage sufficient to refuse relief, so a freezing and tracing order in respect of the shares was just and equitable and should be made.
