The Court allowed the appeal, admitted the newly produced evidence under the modified Ladd v Marshall test given the Defendant's investigative handicaps and the evidential effect of the material when considered collectively, and concluded the Defendant had raised a credible foundation for a triable inference that the Plaintiff may have had knowledge or notice of the fraud; accordingly summary judgment was set aside and unconditional leave to defend was granted.
