The Master Jones order striking out the claim is set aside because the plaintiff was allowed to add a plaintiff and amend the Statement of Claim which cured the pleading defects; however, on the original pleading the Master was not wrong to strike out for no reasonable cause of action and the costs order below in favour of the defendant remains appropriate; the merits of the pleaded implied assignment and construction of the agreement must be determined at trial after evidence.
