On full appraisal of the evidence the trial judge was entitled to find that the jewellery was given outright to the second defendant rather than transferred on trust; the plaintiff failed to establish the necessary entrustment and the circumstances and uncontested facts supported an inference of gift, so the appeal was dismissed; separate claims against the second defendant for land and shares were not maintainable absent pleadings against her.
