Once the vendor had completed the sale and thereby disposed of his interest prior to registration of the charging order, the charging order could not be registered against that vendor's interest to obtain priority; a charger is not a bona fide purchaser for value under s.3 and therefore cannot defeat the plaintiff's assignment; late registration of the assignment (subsequently registered) did not render the assignment void; declaration granted that plaintiff's interest is free from the charging order.
