The court found on balance that the Defendant signed the Chinese Agreement shortly after 4 August 2006, rejected the Defendant's account as not credible, found no admissible evidence that the Building Licence was obtained by a false declaration and rejected the non est factum defence; accordingly the Defendant holds the 1/F, 2/F and Roof on trust for the Plaintiff and must execute the transfer documents and deed of mutual covenant within the prescribed time or be authoritatively bound by solicitors acting on his behalf.
