Application for certification was refused because it was filed many months out of time without good reason and because no point of law of great and general importance arose: the audibility complaint was not substantiated and had been raised and resolved at trial, juror evidence was not justified, s54(1)(b) was inapplicable as the applicant gave evidence, and the trial judge's directions adequately addressed any suggestion of adverse inference from failure to call alibi witnesses.
