The court found the Tuenbo Parties used the Amended 2095 Summonses to relitigate the Authority Issue already determined against them and thereby abused the court process and materially increased the hearing length and costs; accordingly the court departed from the usual costs-in-the-cause approach and ordered the Tuenbo Parties to pay Steadfast's costs of the 2095 Summons and Amended 2095 Summons with certificates for two counsel, while leaving costs of the Amended 566 Summons as costs in the cause, and awarded Steadfast $80,000 for the costs of the variation application.
