The Tribunal found that LCY had been held out and permitted by the Applicant and the Lai family to act in tenancy matters for the Prince Edward Road West premises over a sustained period, creating apparent authority; the Respondent paid rents to LCY and received receipts from the Applicant’s form of documentation; the Applicant failed to prove effective revocation of LCY's authority prior to those payments and produced no contemporaneous evidence to contradict the practice; accordingly the Respondent discharged its payment obligations and the Applicant's possession application was dismissed.
