Defendant's application to stay was dismissed because it failed to establish that Djibouti was clearly or distinctly the more appropriate forum; Hong Kong has the most real and substantial connection overall (service, decision‑makers, documentary evidence, governing law links) and Plaintiffs would suffer a real juridical disadvantage if trial were in Djibouti (notably inability to secure key witness Boreh and credible risk of unfair treatment), outweighing advantages of Djibouti forum for certain discrete issues (eg authority of administrator).
