Although the solicitors' neglect in failing to deal promptly with the Notice of Appeal was unreasonable, because the Respondent's Notice was only to affirm the decision, no prejudice to the appellant was shown and no delay to the hearing resulted, the court exercised its discretion to grant an extension of time subject to undertakings by the solicitors to personally pay the defendant's costs and not to charge their client.
