Action against the office of the Chief Bailiff is misconceived; the proper defendant would be the individual executing bailiff; on the facts the executing bailiff made an honest mistake and was entitled to the common law protection because the plaintiff failed to demonstrate a real or substantial grievance and had refused an earlier offer to retrieve the goods; claim dismissed with costs to defendant.

The bailiff acted as an officer of the court pursuant to a valid writ and there was no evidence the second defendants or their solicitors directed or misled the bailiff to seize goods not of the judgment debtor; therefore the second defendants are not liable for conversion and judgment is for the defendants.
