The court held that given the magnitude of the frauds, the applicant's central role, the planning, use of forged identity and title documents and the aggravating factor of coming from the Mainland to commit the offences, the starting points and the total sentence (after one‑third reduction) were appropriate; comparison with lesser roles in HKSAR v Kong Hon Yui was inappropriate; therefore leave to appeal was refused and the 4‑year sentence was upheld.
