Default judgment was entered for the Plaintiff because the Statement of Claim was served and no defence filed; on the pleaded facts the funds in the defendant's Dah Sing Bank account were held on constructive trust for the Plaintiff; declarations to that effect were granted and the proprietary and Mareva injunctions were continued for six months to secure recovery; a minor calculation error reducing the proprietary declaration by HKD 400 was corrected and accrued interest of USD 1.11 was excluded from the declaration.
