The application for leave to appeal was refused because the proposed grounds had no reasonable prospect of success and there were no other reasons in the interests of justice: the trial judge correctly found no trust, adequately addressed constructive notice as an alternative, correctly ordered surrender of vacant possession as the second defendant was in occupation, and the jurisdictional challenge had already been dismissed; accordingly no leave or stay was justified.
