- Court
- Court of Final Appeal
- Case number
- FACC5/2013
The Court held that 'proceeds of an indictable offence' in s25(1) OSCO is confined to property derived from or representing a benefit obtained from the predicate offence; section 2(6)(a) does not convert clean funds intended as instruments of crime into 'proceeds' absent a reward/benefit link; accordingly the evidence did not establish the alleged money‑laundering conspiracy (Charge 4) and the convictions were quashed.
