The Court of Appeal held the judge did not misapply the governing legal principles: the paramountcy of the child's welfare was applied via a holistic balancing exercise, the Payne guidance was not applied rigidly, the judge gave cogent reasons for departing from the SWO report, the fresh and late evidence was not sufficiently useful to alter the outcome, and the mother failed to demonstrate the father had been obstructive to access; accordingly leave to appeal was refused and costs awarded to the father.
