The applicants failed to identify any question of great general or public importance under s22(1)(b) and their assertions of predetermination/bias were without merit; therefore no leave to appeal to the Court of Final Appeal was warranted and the notice of motion is dismissed.

Leave to apply for judicial review was refused because the applicant's complaints about the Board were not reasonably arguable: the Board conducted a proper rehearing, its adverse credibility and merit findings were supported by the record, and no unfairness or legal error of sufficient arguability was demonstrated to justify judicial intervention.

Applying established tests for bias and for sufficiency of evidence the court found no real danger of bias or unlawful predetermination by Mr Choy; the decision‑maker legitimately relied on Mainland verification, UNHCR and country‑condition material and had probative evidence to conclude applicants had received durable solutions on the Mainland; therefore removal orders and detention decisions were lawfully made and the judicial review failed.
