There was no real dispute of fact because all material facts (allegations, WT report, Mr Yau's conviction and legal advice) were known to owners when the contested resolutions were passed; the December 2017 Resolution bindingly affirmed the owners' obligation to settle the renovation claim, so the defendant's summons to continue as if begun by writ is dismissed and enforcement of charges may proceed.
