The Official Receiver failed to discharge the onus of proving that the debtor's dominant intention in executing the transfers was to prefer Law Chiu; although pressure was exerted by Law Chiu, the evidence did not establish that the dominant intent was to give a preference, therefore the transactions were not fraudulent preferences under s.49 and the motion was dismissed.
