Although the plaintiff has minimal paid‑up capital and there is a real risk it might be unable to pay defendants' costs, the Court found credible evidence of a bona fide claim and a reasonable chance of success supported by evidence of alleged massive fraud; applying the Sir Lindsay Parkinson factors and s.357 the Court exercised its discretion not to order security for costs and refused the application.
