The Tribunal held the respondent breached paragraph 1(c) of the Schedule because the tenant committed the prohibited acts (goods and canopies in common areas) and the respondent had not taken appropriate action to abate or rectify the breach despite recovery proceedings and consent orders; where no arguable defence exists enforcement may proceed summarily but relief must be confined to and not extend the agreed Schedule.
