The judge rejected the existence of any binding Marriage Agreement or representations of a committed marriage on credibility and objective grounds; accepted that the plaintiff funded certain property purchases and payments but concluded those funds were absolute gifts out of love (not conditional on marriage); plaintiff failed to prove the alleged loans and failed to prove the defendant took the sapphire ring; therefore equitable remedies (constructive trust, resulting trust, estoppel), misrepresentation and unjust enrichment claims fail and the plaintiff's claims are dismissed.
