The court applied the House of Lords and Court of Appeal authorities establishing that a former client who proves the solicitors possess confidential information relevant to an adverse matter is entitled to an injunction unless the solicitors prove there is no real risk of disclosure; given the interlocutory nature the American Cyanamid approach is used and the defendant bears the heavy burden to show by clear and convincing evidence that information barriers or other measures eliminate any real risk.
