Because the defendant had been convicted of using a copy of a false instrument and the trial judge in the criminal proceedings expressly found the plaintiffs' copy genuine and the defendant's copy forged, and because Evidence Ordinance s62 permits use of that conviction and shifts the legal burden to the defendant who declined to give evidence or otherwise rebut the conviction, the defendant's defence and counterclaim were bound to fail; the court therefore struck them out and entered the declarations sought by the plaintiffs.
