The Court of Appeal held that (1) lost years damages under Larco are a distinct head recoverable by the estate following Pickett and Gammell, (2) the Chief Justice correctly treated the $36,000 lost years award as net savings to the estate after accounting for the deceased's likely expenditure on dependants and thus that $36,000 does not merge with the $56,640 Fatal Accidents award, and (3) the $15,000 award for loss of expectation of life should merge with the Fatal Accidents award. The appeal was dismissed and the cross-appeal allowed on that basis.
