Where an acquittal is founded on reasonable doubt rather than on a mere technicality, mere suspicion of the defendant's conduct is insufficient to displace the normal practice of awarding taxed costs to an acquitted defendant; therefore the magistrate erred in refusing costs and the appeal is allowed.
