The appeal was dismissed because, on a de novo hearing, although there was material non-disclosure in the ex parte application concerning the outer-box Caution, the 2nd and 3rd defendants had, by their conduct in the case management hearing and subsequent participation without an express reservation, objectively submitted to the jurisdiction and waived any challenge to the Service Out and Extension Orders; therefore the Master’s orders were upheld and the defendants’ challenge failed.
