The Coroner directed that seven next of kin will participate; death investigation reports and witness statements have been provided to properly interested persons; the substantive inquest is listed to commence on 6 May 2025 with 60 days reserved; a third pre-inquest review is scheduled for 14 January 2025 to deal with requests for further information and outstanding matters.

The court held that although Yam J was justified in wanting an early disposal, the bringing-forward of the quantum hearing to 18–22 January 2010 on the short notice given created unacceptable prejudice and uncertainty given the complexity of the hearing and witness availability; accordingly leave to appeal against the 12 January 2010 order was granted and the order was set aside while the separate 10 December 2009 challenge to Yam J's reservation of the quantum hearing was dismissed for lack of merit. An informed decision on whether the construction issue was susceptible to interlocutory determination required substantive engagement with the merits; for case management and efficiency the appropriate course was to list both appeals to be heard together with sufficient time to argue both the procedural question and the construction issue, and to include the appeal against the amendments in that listing.
