The court exercised its case management discretion to grant an interim stay of these Hong Kong proceedings pending final determination of the Privy Council appeal because the balance of interests favored preventing waste of judicial and party resources and guarding against injustice to defendants, there was no demonstrated real risk of dissipation of the HK Funds, and sensible management permitted adjournment of the O.14 hearing; the stay is subject to an exception that Green Elite may apply to freeze or preserve the HK Funds to protect its enforcement interests.
