On the balance of probabilities the 1st Defendant negligently attempted to overtake on the opposing lane causing the Plaintiff to brake abruptly and suffer neck and back soft tissue sprains; causation and quantum were established and damages awarded accordingly; the 2nd Defendant is not vicariously liable because there was no agency/master-servant relationship or evidence of acting in the 2nd Defendant's service.
