The trial judge applied the wrong legal test by asking why the payments were made rather than why they were accepted; on the facts found (agent arranged inflated invoices and received secret rebates) the acceptance satisfied s9(1)(b) as an advantage accepted as inducement/reward/on account of showing favour; the judge erred in acquitting and the matter is remitted to the trial judge to proceed in accordance with this Court's opinion.
