    The judge erred in summarily dismissing the originating summons as obviously unsustainable because it was reasonably arguable that the memorandum allowed implication of a term that Chow be given reasonable time to raise capital for completion; accordingly the matter was remitted to the Court of First Instance for rehearing and the defendant's application for leave to appeal to the Court of Final Appeal was dismissed as not raising questions of great general or public importance; costs were ordered for the respondent and assessed by the court.
