The Court held that Article 2(1)(xxxiv) operates as a catch‑all clause and, properly construed in context, escape from lawful custody met the article's two conditions (punishable by at least one year and surrender may be granted under the laws of both parties); the circularity argument was rejected and therefore the application for a certificate under Cap 484 s32(2) did not raise a point of great and general importance and was refused.
