The learned Magistrate was entitled to rely on the s.28 certificate and the expert's explanatory evidence; the appellant produced no evidence to rebut the statutory presumption or to show the device was unreliable, and the device's margin of error was insufficient to negate that the speed exceeded the legal limit, so the conviction must stand.
