The Plaintiff failed to prove a common intention constructive trust because contemporaneous Running Accounts and the Purported Will demonstrate the Winnings were treated as repayable loans and monthly payments as living expenses; consequently resulting trust and proprietary estoppel claims fail and no equitable proprietary interest was established in the Premises in favour of the Plaintiff.
