Court accepted plaintiff's bank passbook and contemporaneous documentary records over the defendant's self-prepared repayment ledger and unreliable receipts; found plaintiff received only HK$250,000; rejected psychiatric injury claim for lack of medical evidence; accordingly awarded plaintiff HK$250,000 plus specified interest and costs.

On the evidence and applying appropriation principles the court found the cheque was handed in the context of repeated demands for the HKSI first instalment and that the debtor's intention to appropriate the payment to that instalment was clear and binding; accordingly the Plaintiff's claim for $300,000 failed.
