Although the conviction was quashed because the footage lacked the requisite sexual element under the statute, the appellant’s secret filming of adults and a child in a toilet was reprehensible and objectively invited suspicion and misled the prosecution; applying the established discretionary principles the court properly refused the appellant’s application for costs.
