    The court upheld the conviction: the trial judge properly found the child complainant credible and the identification reliable based on multiple encounters and a reliable recognition procedure; the touching was deliberate not accidental; although the judge erred in attributing the October incident to the appellant, that error was immaterial to the safety of the conviction because the identification from the November/December encounter and the February incident together proved identity beyond reasonable doubt, and the judge applied Turnbull caution appropriately.

    Given the extreme seriousness of the offences (knife-enabled abduction of an almost 11-year-old, robbery and attempted rape with forced oral sex), the starting points chosen by the judge were justified, the generous discount for robbery balanced a relatively smaller discount for attempted rape, consecutive sentences were appropriate and the total effective sentence of 12 years was within the permissible range; leave to appeal against sentence is refused.
