Although the plaintiff produced documents supporting an oral loan, the defendant failed to raise a direct triable issue on the oral agreement; however, because the transactions may relate to a chit fund and the personal representative requires the opportunity to investigate in absence of the deceased, the court granted unconditional leave to defend and ordered disclosure and cross-examination to determine whether a trial is required.
