The court preferred the defendant's contemporaneous WhatsApp evidence over the plaintiff's inconsistent testimony and found the 1st and 6th Sums were investments (stock and gold respectively) rather than loans; the 2nd and 3rd Sums were advances intended to be on-lent to a third party for interest; after appropriate appropriation of repayments the defendant was ordered to pay the plaintiff HK$312,877 with judgment interest, costs to follow the event.
