The Court of Appeal concluded that the trial judge's summing-up on Count 1 was unbalanced and materially mischaracterised and undermined the applicant's defence by discrediting defence scenarios and introducing impermissible reasoning during directions on drawing inferences, producing a miscarriage of justice; accordingly the conviction for trafficking (Count 1) was quashed and sentence set aside. The directions on Count 2 were adequate and the application in relation to Count 2 was dismissed.
