The Court upheld the judge's finding that the Lung Kai genealogy and the long-term conduct (non-participation and payment of subsidies) established a fen-jia such that the Kung Cheung and Hon Cheung fongs had taken their shares upon removal and were disentitled to benefits of Kan Tak Chung Tso; accordingly the plaintiffs' appeal was dismissed.
