The application for clarification was dismissed because no ambiguity existed in the sealed Costs Order when the written Ruling on Costs (31 January 2005) was available to the Taxing Master; the slip rule did not apply as no clerical mistake or amendment was sought; accordingly the court refused to exercise any power to clarify the sealed order and ordered that the costs of the application be the subject of a costs nisi in favour of the 2nd, 3rd and 4th defendants to be taxed if not agreed.
