Leave to appeal was granted only on two grounds: the failure to direct the jury that they may consider the co-defendant's evidence as potentially favourable to the applicant, and the failure to give an appropriate direction on flight/escape. Leave was refused on the police‑credibility ground because the trial judge's general directions were adequate and displayed appropriate judicial scepticism, and on the duplicity ground because Chau Yui Ming was inapplicable where the defence advanced a single, coherent fabrication scenario rather than multiple viable defences.
