Clause 16 did not create a condition precedent preventing the Plaintiff from suing; the property was held in common as equal undivided shares and clause 12 limits rights to affix signboards so unilateral erection by the Defendant without lawful authority amounted to interference with co-owners; no triable defence or evidence of lawful permission was established; accordingly summary judgment was appropriate and ordered removal, reinstatement and assessment of damages.
