The application to adduce fresh evidence was dismissed because the Defendant failed to show the evidence could not have been obtained with reasonable diligence before the summary judgment hearing and, even if admitted and believed, it would not have had a sufficiently important influence to raise a triable issue (collective sale prospects remained uncertain); accordingly the Ladd v Marshall test as modified for summary judgment was not satisfied.
