    HCAJ246/1999

Work performed by Mr Apostolis, though he was a foreign lawyer not yet locally qualified for part of the period, was work provided by the firm Sinclair Roche and did not constitute 'acting as a solicitor' in breach of Legal Practitioners Ordinance s45; accordingly costs were recoverable (s50 not engaged), Regulation 12 did not bar recovery, and the Registrar's assessed rate of HK$3,000 per hour was upheld.

CHAN CHUNG-FAI v. THE PILOTAGE AUTHORITY

    Citation
CHAN CHUNG-FAI v. THE PILOTAGE AUTHORITY
    Court
    Court of First Instance
    Case number
    HCMP64/1979

The court accepted that the appellant breached pilotage duties by proceeding at unsafe speed, manoeuvring into congested waters and displaying confused/contradictory orders at the point of imminent collision, but rejected the Board's finding that the situation was a reciprocal head-on meeting under Rule 14; the cancellation of the licence was excessive and the matter of penalty is to be remitted to the Board for reconsideration.
