The court refused to amend the draft order: it declined the Defendants' request to limit interest to the date of the Judgment and declined to vary the costs order nisi under s.25 MLO because the court is functus officio on the interest issue and s.25 MLO did not warrant altering the costs exercise; the order is to be drawn as proposed by Premier Capital and no costs are awarded for the parties' preparation of submissions on the draft order; the Defendants remain free to pursue the point on appeal.
